Terms of Service

1. Acceptance of Terms

By accessing or using the Movie Poster Exchange ("MPE") website and services, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use our services. We reserve the right to modify these terms at any time, and your continued use of the platform constitutes acceptance of any changes.

2. Account Registration

To use certain features of MPE, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years of age to create an account. MPE reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

3. Buying and Selling

MPE provides a platform for buyers and sellers to transact. MPE is not a party to the transactions between buyers and sellers. Sellers are responsible for the accuracy of their listings, including descriptions, images, and condition grading. Buyers are responsible for reviewing listings carefully before purchasing or bidding.

All sales are between the buyer and seller. MPE facilitates the transaction but is not responsible for the quality, safety, or legality of items listed, the accuracy of listings, or the ability of sellers to sell or buyers to pay.

4. Auctions and Bidding

Bids placed on timed auctions are binding commitments to purchase the item at the bid price if you are the winning bidder. Proxy bidding is used to automatically bid on your behalf up to your maximum bid amount. Extended bidding may apply to prevent last-second bidding.

Bid retractions are generally not permitted except in cases of clear error, as determined by MPE at its sole discretion. Winning bidders are expected to complete payment promptly.

5. Fees and Payments

MPE may charge fees for certain services, including seller commissions on completed sales. Current fee structures are available in the seller dashboard. All payments are processed through PayPal. By using our platform, you agree to PayPal's terms of service in addition to these terms.

6. Prohibited Conduct

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws
• List counterfeit, stolen, or misrepresented items
• Manipulate auctions through shill bidding or bid manipulation
• Interfere with or disrupt the platform or its infrastructure
• Create multiple accounts to circumvent bans or restrictions
• Harass, threaten, or abuse other users
• Attempt to circumvent platform fees by completing transactions outside of MPE

7. Intellectual Property

The MPE platform, including its design, features, and content, is the intellectual property of Movie Poster Exchange. You may not copy, reproduce, or distribute any part of the platform without prior written permission. Sellers retain ownership of the content they upload but grant MPE a license to display and use that content in connection with the platform.

8. Limitation of Liability

MPE provides the platform "as is" without warranties of any kind, either express or implied. To the fullest extent permitted by law, MPE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the platform. MPE's total liability shall not exceed the fees paid by you to MPE in the twelve months preceding the claim.

9. Dispute Resolution

In the event of a dispute between buyers and sellers, MPE may, at its discretion, assist in resolving the dispute but is not obligated to do so. Any disputes arising from these terms or use of the platform shall be resolved through binding arbitration in accordance with applicable law.

10. Termination

MPE reserves the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these terms. Upon termination, your right to use the platform ceases immediately. Any pending transactions may be completed or cancelled at MPE's discretion.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes via email or a notice on the platform. Your continued use of MPE after such changes constitutes your acceptance of the updated terms.
